Welcome to Cycleworld.

These Terms of Service govern your access to and use of the website, products and services provided by Cycleworld Australia Pty Ltd, ABN 79 115 810 216, trading as Cycleworld. References to “Cycleworld”, “we”, “us” and “our” mean Cycleworld Australia Pty Ltd.

Our registered office and physical retail store are located at:

317 Concord Road
Concord West NSW 2138
Australia

By accessing or using any part of our services—including browsing our website, purchasing products online or in store, or using our workshop—you agree to these Terms. If you do not agree to these Terms, you must not access the website or use our services.

1. General Terms

1.1 Acceptance of Terms

These Terms form a legally binding agreement between you and Cycleworld.

You confirm that you are at least the age of majority in your state or territory of residence. Alternatively, you confirm that you are the age of majority and have consented to any of your minor dependants using this website.

1.2 Changes to these Terms

We may update, change or replace any part of these Terms by publishing the revised Terms on our website.

You are responsible for checking this page periodically for changes. Your continued use of the website or our services after changes are published constitutes acceptance of the updated Terms.

1.3 Governing law

These Terms, together with any separate agreement under which we provide services to you, are governed by the laws of New South Wales and the Commonwealth of Australia.

1.4 Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will remain enforceable to the maximum extent permitted by law.

Any unenforceable portion will be treated as severed from these Terms without affecting the validity or enforceability of the remaining provisions.

1.5 Entire agreement

These Terms, together with any policies or operating rules published by us on the website or relating to our services, constitute the entire agreement between you and Cycleworld concerning your use of our services.

They replace any previous or contemporaneous agreements, communications or proposals, whether oral or written, including previous versions of these Terms.

2. Product Sales—Retail and E-commerce

Cycleworld sells bicycles, parts and accessories through our physical retail store and e-commerce website.

2.1 Product descriptions and availability

We make reasonable efforts to ensure that product descriptions, images and prices displayed online and in store are accurate. However, errors, inaccuracies or omissions may occur.

We may correct or update information at any time without prior notice. Where information concerning a product, price or order is incorrect, we may cancel an affected order, including after the order has been submitted.

All products and services are subject to availability.

We may limit sales of products or services to particular people, geographic regions or jurisdictions. This right may be exercised on a case-by-case basis.

2.2 Pricing

All prices are displayed in Australian dollars and include Goods and Services Tax where applicable.

Prices may change without notice.

The price charged will be the price applying when the order is placed and will be recorded in the applicable order confirmation, quotation or tax invoice.

2.3 Order acceptance and confirmation

Submitting an order online or in store does not guarantee that Cycleworld will accept it.

We may refuse or cancel an order for reasons including:

  • Product unavailability;

  • Incorrect pricing;

  • Incorrect product information; or

  • Problems verifying payment.

For online purchases, an order confirmation email will be sent after the order has been submitted successfully. This confirms that we have received the order but does not constitute acceptance.

Acceptance of the order and formation of the sale contract occur when:

  • The products are dispatched; or

  • The customer is notified that a Click and Collect order is ready for collection.

2.4 Payment methods

Available payment methods may include:

  • Major credit and debit cards;

  • Bank transfer for eligible transactions; and

  • Third-party payment services displayed at the point of sale, including Zip.

By providing payment information, you confirm that you are authorised to use the selected payment method.

You authorise Cycleworld to charge that payment method for the full order amount, including applicable taxes, shipping costs and other disclosed charges.

2.5 Shipping and delivery

Shipping charges and estimated delivery timeframes for online orders will be calculated and displayed at checkout.

Cycleworld uses third-party couriers. Although we endeavour to meet the estimated delivery timeframes, they are estimates only. To the extent permitted by law, we are not responsible for delays caused by couriers or circumstances outside our control.

Risk of loss and title to products purchased from Cycleworld pass to the customer when the products are delivered to the carrier.

If a courier is found to have breached its terms of service, Cycleworld will assist the customer with suitable recovery options.

Further information is available in our Shipping and Delivery Policy.

2.6 Click and Collect

Customers using Click and Collect will be notified when their order is ready at:

317 Concord Road
Concord West NSW 2138

Valid photo identification and the relevant order confirmation must be presented when collecting an order.

Orders that are not collected within a reasonable period, such as 14 days after the collection notification, may be cancelled and refunded. A restocking fee may apply.

2.7 Returns, refunds and exchanges

Cycleworld’s goods and services include guarantees that cannot be excluded under the Australian Consumer Law.

Customers are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. Customers are also entitled to have goods repaired or replaced where they are not of acceptable quality and the failure is not a major failure.

Change of mind

Cycleworld is not legally required to provide a refund or replacement where a customer simply changes their mind.

At our discretion, we may offer an exchange or store credit where an item is returned within the specified period, such as seven days, and:

  • The item is unused;

  • The item is in its original condition;

  • All original packaging is included; and

  • Valid proof of purchase is provided.

A restocking fee may apply.

Faulty products

Where a product has a major failure, the customer may be entitled to choose a refund, replacement or repair.

Where a product has a minor failure, Cycleworld may choose to repair or replace it.

Valid proof of purchase must be provided.

Return process

To request a return, refund or exchange:

  • Email: [insert sales email address]; or

  • Visit our store at 317 Concord Road, Concord West NSW 2138.

We may require the product to be returned for inspection and assessment.

3. Workshop Services

Cycleworld operates a full-service bicycle repair and maintenance workshop.

3.1 Service descriptions and quotations

Information about available workshop services and estimated pricing may be provided through our website, on request or in store.

We will provide a quotation before beginning any significant repair work.

The final price may vary if additional issues are identified while the bicycle is being serviced. Where additional work would cause the final cost to significantly exceed the original quotation, we will endeavour to contact the customer and obtain approval before proceeding.

3.2 Bookings, drop-off and collection

Workshop services may require an appointment.

Customers are responsible for delivering and collecting their bicycles from the workshop during Cycleworld’s operating hours.

3.3 Thirty-day workshop warranty

Cycleworld provides a 30-day warranty covering labour performed and parts installed by our workshop. The warranty period begins on the date the service is completed.

This warranty covers defects in:

  • Workshop workmanship; and

  • Parts and materials used in the repair.

Warranty exclusions

The workshop warranty does not cover:

  • Normal wear and tear affecting components that were not replaced or directly serviced by Cycleworld;

  • Damage caused after the service by misuse, neglect, accident or improper maintenance;

  • Repairs or modifications performed by another party after Cycleworld completed the service; or

  • Damage or defects that existed before the service and did not relate to the items serviced.

Making a warranty claim

If you believe an issue is covered by the workshop warranty, contact Cycleworld within 30 days of the service being completed:

  • Email: [insert workshop email address]; or

  • Return the bicycle to our workshop with valid proof of service.

We will assess the issue. Where the warranty applies, Cycleworld may, at its discretion:

  • Perform the relevant work again;

  • Repair the problem; or

  • Replace the faulty part.

The workshop warranty is provided in addition to any rights and remedies available under the Australian Consumer Law. It does not limit or exclude those rights.

3.4 Uncollected bicycles and other items

Bicycles and other items left with our workshop must be collected within 30 days after we notify the customer that the work is complete.

Cycleworld may charge a storage fee where an item is not collected within that period.

If an item remains uncollected for 90 days, and we have made reasonable attempts to contact the customer, Cycleworld may sell the item to recover outstanding costs or dispose of it in accordance with applicable New South Wales laws.

4. Layby Purchases

Cycleworld offers layby arrangements for eligible purchases.

4.1 Layby period

The standard layby period is three months from the date the layby agreement begins.

4.2 Deposit and payments

A minimum deposit is required to secure a layby purchase. The required deposit will be specified when the agreement is made.

Regular payments must be made throughout the three-month layby period.

Cycleworld will retain possession of the product until the full purchase price has been paid.

4.3 Cancellation of a layby

Customers may cancel a layby agreement at any time before making the final payment.

Cancellation fee

Cycleworld may charge a reasonable cancellation fee. The fee will be disclosed when the layby agreement is established.

The cancellation fee may cover reasonable administrative costs and any reduction in the value of the goods. It will be deducted from the money already paid by the customer.

Refund following customer cancellation

Amounts paid by the customer will be refunded after deducting the applicable cancellation fee.

Cancellation by Cycleworld

Cycleworld may cancel a layby agreement where:

  • The customer fails to make payments as agreed; or

  • The product becomes unavailable because of circumstances outside our control.

Where Cycleworld cancels the agreement for one of these reasons, all amounts paid by the customer will be refunded without deducting a cancellation fee.

Each layby is also subject to the specific conditions contained in the individual layby agreement provided when the purchase is made. Those conditions will be consistent with the Australian Consumer Law.

5. Purchases Financed Through Zip

Cycleworld facilitates financed purchases through Zip.

5.1 Third-party finance provider

Zip is an independent third-party credit provider.

When choosing Zip to finance a purchase, the customer enters into a separate agreement directly with Zip.

5.2 Zip terms and conditions

The use of Zip is governed by Zip’s:

  • Terms and conditions;

  • Privacy policy; and

  • Eligibility and approval criteria.

Customers should review these documents on Zip’s website before proceeding with a Zip payment.

5.3 Cycleworld’s role

Cycleworld’s involvement in a Zip-financed purchase is limited to facilitating the payment transaction.

Cycleworld:

  • Is not a credit provider;

  • Does not decide whether a customer is approved for credit; and

  • Does not determine the terms of the customer’s finance agreement with Zip.

Questions or disputes concerning a Zip finance agreement, payments made to Zip or a customer’s Zip credit account must be directed to Zip.
